Giada, LLC (dba “Giada Transportation”) – Terms & Conditions

1. Introduction
These Terms and Conditions (“Terms”) govern the access to and use of the transportation, driving, and security services provided by Giada, LLC, doing business as Giada Transportation (“Giada,” “we,” “our,” or “us”). By engaging our Services, including through our website (https://giadatransportation.com) or any affiliated booking platform, you (“Client,” “Passenger,” or “you”) acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy, which forms an integral part of this Agreement.
Giada operates as a licensed private-car and security-transportation provider under California TCP 48638-A, in compliance with the California Department of Transportation (Caltrans) and the California Public Utilities Commission (CPUC).

2. Scope of Services
Giada provides private, reservation-based luxury transportation services, including:

Executive Driver Service

Armed Driver Service

Private Security Detail Service
All services are offered within Southern California and surrounding regions, subject to availability and prior confirmation. Giada reserves the right to decline or modify any service request at its sole discretion.

3. Reservations and Use

All rides and security services are by reservation only and must be confirmed by Giada before service is rendered.

Passengers must be 18 years of age or older or accompanied by an adult.

Services may not be used for any illegal, unsafe, or disruptive activities, including the possession or transport of contraband, weapons, or controlled substances.

Pets must be confined in secure carriers.

Smoking, vaping, and open alcohol containers are strictly prohibited in all vehicles.

Giada reserves the right to refuse service to any person or group for safety, regulatory, or behavioral reasons.
4. Payment and Cancellation Policy

Giada accepts payment via Stripe, Apple Pay, Google Pay, and major credit cards.

Prepayment or deposit may be required to secure a booking.

Cancellations are subject to the following standard policy:

Cancellations made 24 hours or more before scheduled pickup are eligible for a full refund.

Cancellations made within 12–24 hours of pickup are charged 50% of the total fare.

Cancellations made less than 12 hours prior to pickup or no-shows are charged 100% of the total fare.

Final pricing is based on duration, security tier, itinerary, and specific service requirements.

Rates are subject to change without prior notice and will be confirmed upon booking.
5. Security and Armed Services

Armed driver and private security detail services are performed only by licensed and trained personnel in accordance with California law.

Firearms are carried exclusively by Giada’s authorized personnel; clients and passengers may not possess weapons while in Giada vehicles.

Passengers must comply with all safety instructions issued by Giada drivers or security staff.

Giada maintains comprehensive commercial liability and vehicle insurance as required under its TCP license.

Giada shall not be held liable for injury, delay, loss, or damage arising from acts of third parties, adverse weather, mechanical issues, or events beyond its reasonable control.
6. Conduct and Vehicle Condition

Giada reserves the right to terminate a ride immediately if a passenger behaves in a manner deemed unsafe, abusive, or disruptive.

A minimum fee of $150 may be assessed for cleaning or damage to a vehicle resulting from passenger conduct, including but not limited to spills, stains, or property damage.

Passengers are responsible for their personal belongings. Giada assumes no liability for items lost or left behind.
7. Safety Recordings

For the protection of clients and personnel, Giada vehicles are equipped with onboard audio and/or video cameras.

By using Giada’s Services, passengers consent to such recordings.

Recordings are used strictly for safety, insurance, and compliance purposes, retained for ninety (90) days, and may be disclosed to law enforcement or insurance representatives if required by law.

Footage will not be used for marketing, surveillance, or public dissemination.
8. Service Interruptions and Force Majeure
Giada shall not be responsible for delays, missed flights, or interruptions caused by events beyond its reasonable control, including but not limited to traffic congestion, accidents, severe weather, civil disturbances, road closures, law enforcement actions, or mechanical failures.
Giada may, at its sole discretion, offer alternative transportation or partial refunds, but such remedies are not guaranteed.
9. Limitation of Liability
To the fullest extent permitted by law, Giada, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or relating to the Services.
In no event shall Giada’s total liability exceed the amount paid by the Client for the specific service giving rise to the claim.
Clients acknowledge that transportation inherently involves risks and accept such risks voluntarily.
10. Indemnification
Clients agree to indemnify, defend, and hold harmless Giada, its owners, employees, contractors, and affiliates from and against any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from:
(a) Misuse of the Services;
(b) Violation of these Terms; or
(c) Negligent or unlawful conduct during service.
11. Intellectual Property
All content appearing on the Giada website and associated materials, including text, logos, photography, video, and design elements, are the exclusive property of Giada, LLC (dba Giada Transportation) and protected under applicable intellectual property laws.
Reproduction or reuse of such materials without prior written authorization is strictly prohibited.
12. Arbitration and Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.
Any dispute arising under or in connection with these Terms shall first be submitted to binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association (AAA).
If arbitration is deemed unenforceable, venue shall rest exclusively in the state or federal courts located in Los Angeles County, California. Each party waives any right to a jury trial.
13. Privacy Policy
By using our Services, you acknowledge and agree to the terms of Giada’s Privacy Policy, available at https://giadatransportation.com/privacy-policy, which governs the collection and processing of personal information.
14. Modifications to Terms
Giada reserves the right to update or amend these Terms at any time without prior notice.
The “Effective Date” above indicates the latest revision. Continued use of the Services following publication of changes constitutes acceptance of the updated Terms.
